Acceptable Use Policy

This Acceptable Use Policy (“Policy”) intends to outline the Terms and Conditions that govern your use of the services and products of Cenobe. By using the products and services of Cenobe, you (“user”) agree to comply with this Policy.

1. User Responsibilities

Content Ownership. You remain the sole proprietor of your content, i.e. you retain ownership of the content you create and share while using the products and services of Cenobe. As necessary for Cenobe to provide its Services, a non-exclusive, worldwide, royalty-free license to use, distribute and display such content shall be granted by the user.

Account Security. The user is solely responsible for maintaining the confidentiality of the user’s account information, such as passwords and/or activities that occur under the user’s account.

Compliance. The user agrees to comply with all applicable laws, regulations and this Policy while using the services and products of Cenobe.

2. Prohibited Activities

While using our Products and Services the user agrees to refrain from all the following activities:

  • No engagement in illegal activities. It is strictly prohibited to conduct any activity that violates local, national and international laws and regulations.
  • Intellectual Property Infringement/Trade Secrets. It is strictly prohibited to use, share or distribute content that infringes on the intellectual property rights of others, including copyrights, trademarks, patents. This prohibition also applies to distribution of trade secrets.
  • Harmful Content Distribution. The user is prohibited to share, upload or distribute any content that is harmful, defamatory, offensive, abusive, promotes discrimination of any kind or is otherwise objectionable.
  • Security Compromise. The user is strictly prohibited to engage in any kind of activities that compromise the security of the services of Cenobe, including hacking, malware distribution, phishing and other malicious activities.
  • Spamming and Unsolicited Communications. Sending unsolicited messages, advertisements and/or spamming other users or third parties is strictly prohibited.
  • Misrepresentation. The user is strictly prohibited to misrepresent themselves, impersonate any other person or entity, falsely state or otherwise misrepresent their affiliation and/or connection to a person or entity.
  • Service Disruption. The user is strictly prohibited to interfere with and/or disrupt the operation of the services of Cenobe, Cenobe’s servers and/or networks.

3. Enforcement, Complaints and Termination

Monitoring. When using our products and services, Cenobe reserves the right to monitor and review the user’s use of our products and services, in order to ensure compliance with this policy. Such monitoring may involve the processing of personal data, including technical and usage data. Further information on the legal basis and purposes of such processing is available in CENOBE's Privacy Policy, available at www.cenobe.com.

Complaints. Cenobe takes any complaint very seriously and strives to handle any expression of dissatisfaction properly. If a user has concerns about the behavior or activities of any other user, please don’t hesitate to contact Cenobe at info@cenobe.com.

Violations. In case the user violates this Policy, Cenobe may take appropriate measures, such as suspending the user’s account or terminating the user’s access to Cenobe’s products or services and report violations to law enforcement authorities accordingly.

4. Data Protection and Privacy

When using our products and services the user agrees to comply with the Data Protection laws, such as the General Data Protection Regulation (GDPR) and Privacy Policy of Cenobe. 4.1. CENOBE as Data Controller

CENOBE acts as an independent data controller in respect of personal data provided by the user in connection with the registration and management of the user's account, including name, email address, phone number and any other information submitted during the registration process or in the course of the commercial relationship between the parties. Such personal data is processed by CENOBE for the purposes of account management, service delivery, billing and compliance with legal obligations. The processing of such data is governed exclusively by CENOBE's Privacy Policy, available at www.cenobe.com.

4.2. CENOBE as Data Processor

To the extent that CENOBE processes personal data on behalf of the user in the course of providing the Platform services - including any personal data that may be incidentally accessed during breach and attack simulation, attack surface management or any other service provided through the Platform - CENOBE acts as a data processor within the meaning of Article 28 of Regulation (EU) 2016/679 ("GDPR"), processing such data solely on the instructions of the user who acts as data controller. Such processing is governed exclusively by the Data Processing Agreement ("DPA"), available at https://cenobe.com/dpa. In the event of any conflict between the terms of this Policy and the DPA with respect to the processing of personal data, the DPA shall prevail.

4.3. User's Obligations as Data Controller

The user warrants that it has obtained, or will obtain prior to use of the Platform, all necessary authorisations, consents and permissions required under applicable data protection law in connection with its use of the Platform, including in relation to any personal data that may be incidentally accessed during the provision of the services. The user acknowledges that it is solely responsible for assessing the data landscape of the systems to be tested and for notifying CENOBE in accordance with the DPA where special categories of personal data within the meaning of Article 9 GDPR are present in such systems.

4.4. Content and Personal Data

The licence granted to CENOBE under Section 1 of this Policy does not extend to personal data as defined under applicable data protection law, including the GDPR. Any personal data contained in user content is processed exclusively in accordance with the DPA - where CENOBE acts as data processor, or the Privacy Policy, where CENOBE acts as data controller - as applicable based on CENOBE's role.

4.5. General

Any reference in this Policy to personal data, data protection, privacy or related matters shall be read in conjunction with this Section 4. In the event of any conflict or inconsistency between any other provision of this Policy and either the Privacy Policy, the Cookies Policy or the DPA with respect to the processing of personal data, the Privacy Policy, the Cookies Policy or the DPA - as applicable based on CENOBE's role - shall prevail.

5. Changes to the Acceptable Use Policy

Cenobe reserves the right to update, amend and enhance this Policy from time to time. If this is the case, the user will be notified by posting the updated Acceptable Use Policy on Cenobe’s website. If the user continues to use Cenobe’s products and services after any amendments to this Policy, this shall mean that the user accepts the updated Policy.

6. Jurisdiction and Governing Law

This Policy shall be interpreted according to Greek law and any dispute that may arise from its execution shall be resolved by the courts of Athens, Greece.
